Children born in Detroit are privy to exceptional healthcare, including coordinated care at hospitals and universities, which are comprised of some of the best medical professionals in the field. However, even the best of healthcare professionals can make medical mistakes. If your child developed cerebral palsy due to medical negligence, an experienced Detroit cerebral palsy lawyer may be able to assist you.
Cerebral Palsy Caused by Medical Negligence
Birth injuries leading to cerebral palsy happen for numerous reasons. The most common preventable birth injury causes include:
- Doctors and/or medical staff failing to monitor fetal monitoring
- Physicians failing to order an emergency C-section
- Failure to detect, diagnose, and maternal infections and provide the proper treatment
- Failure to detect, diagnose, and treat umbilical cord issues and/or placenta issues
- Administering the wrong medication or dispensing too much medication to the mother
- Improper use of birth-assisting tools
- Mishandling the infant during delivery
Birth injuries can occur before, during, and shortly after birth. Sometimes medical negligence leading to cerebral palsy can happen months after birth, such as the case with 2-month-old Vin Tran, who was awarded the high cerebral palsy settlement in Michigan history.

$130M Cerebral Palsy Verdict Awarded After Hospital Negligence
In 2006, infant Vihn Tran was admitted into the William Beaumont Hospital for breathing difficulties. According to FOX 2, the little boy suffered a “breath-hold spell” after numerous unsuccessful attempts by the attending medical staff to administer an IV.
Further, the attending technicians failed to promptly call in a “code blue” and didn’t give the infant chest compressions. Subsequently, Vihn developed cerebral palsy after losing oxygen to his brain, creating severe brain damage.
Following an almost month-long cerebral palsy trial, the jury found that Beaumont Hospital “caused severe and permanent brain damage resulting in cerebral palsy,” according to ABC 7.
“Nothing will ease the suffering of this child, but at least this settlement will alleviate some of the financial burdens from his caretakers,” the family’s cerebral palsy lawyer said after the verdict. “I’m grateful for the jurors service and gratified they agreed that this was a preventable tragedy.”
The hospital responded with a statement claiming it “took this case before a jury because we believe the care we delivered was appropriate.”
