This Detroit cerebral palsy lawsuit resulted in the highest-ever jury award for medical malpractice in Michigan.
In 2006, infant Vihn Tran was admitted to the William Beaumont Hospital for breathing difficulties. According to FOX 2, the little boy suffered a “breath-hold spell” after numerous unsuccessful attempts by the attending medical staff to administer an IV.[1]
Further, the attending technicians failed to call in a “code blue” promptly and didn’t give the infant chest compressions. Subsequently, Vihn developed cerebral palsy after losing oxygen to his brain, creating severe brain damage.
Following an almost month-long cerebral palsy trial, the jury found that Beaumont Hospital “caused severe and permanent brain damage resulting in cerebral palsy,” according to ABC 7. A jury awarded the family $130 million in damages.
“Nothing will ease the suffering of this child, but at least this settlement will alleviate some of the financial burdens from his caretakers,” the family’s cerebral palsy lawyer said after the verdict. “I’m grateful for the jurors service and gratified they agreed that this was a preventable tragedy.”[2]
The hospital responded with a statement claiming it “took this case before a jury because we believe the care we delivered was appropriate.”
