Seattle is home to one of the most comprehensive care facilities in the Pacific Northwest when it comes to treatment options for babies and children with cerebral palsy. Renowned physicians have helped many children with cerebral palsy in the area with therapy, counseling, medical treatment, diet, and much more.
What happens, however, when the medical team you trust causes negligence that harms your baby? If your baby developed cerebral palsy due to medical errors and neglect, you are not alone, and an experienced and compassionate Seattle cerebral palsy lawyer can help you.
Seattle Medical Negligence and Cerebral Palsy
Medical negligence is physicians or medical staff and others failing to do what should reasonably be done. This could be anything from failing to order an emergency C-section, failure to administer the correct medication or failure to find, diagnose, and treat maternal illnesses. The list goes on.
The result can sometimes mean your child is left to deal with a lifelong disorder, which can include cerebral palsy and several associated illnesses. Caring for a child with cerebral palsy is expensive, and generally, much more than the average family in the U.S. can afford.
Many families end up paying for expenses that they shouldn’t legally have to. Doctors, hospitals, and other medical facilities and staff have the responsibility to ensure they do everything possible before, during, and the birthing process to keep the infant as safe as possible.
Other instances in which a physician, hospital, and medical negligence can occur include:
- Failure to diagnose a maternal infection
- Inability to use birthing tools correctly, including a vacuum extraction tool or forceps
- Failure to find or correct issues with umbilical cords
- Failure to perform an emergency C-section
- Failure to provide or monitor oxygen treatment
Hospital Negligence Leads to $4.2 Verdict
A Seattle-area girl born with cerebral palsy other debilitating medical issues was awarded $4.2 million in 2008 after her cerebral palsy attorneys proved that negligence occurred during her delivery.
According to court documents obtained by the Kirkland Reporter, a King County jury found Evergreen Hospital guilty of ignoring fetal distress signs, while nurses failed to notify a physician in time for an emergency C-section. In turn, the girl was born with brain damage, which led to cerebral palsy. She’s now severely disabled and has a shortened life span.
“This tragedy was caused when attending nurses did not notify a doctor in time to do a crash C-section which could have prevented the injury,” one of the girl’s lawyers said.
Despite the hospital denying negligence, the presiding judge sided with the victim in the case. Damages awarded include future medical and home care expenses, as well as damages for pain and suffering, past medical bills, and lost capacity of future earnings.
If you think your child may have developed cerebral palsy due to medical mistakes or negligence, you don’t have to wait any longer to find out. An experienced cerebral palsy lawyer will let you know if you have a valid case, and if you do, will work to make sure you get the damages you and your family are entitled to.
