A Seattle-area girl born with cerebral palsy other debilitating medical issues was awarded $4.2 million in 2008 after her cerebral palsy attorneys proved that negligence occurred during her delivery.[1]
According to court documents obtained by the Kirkland Reporter, a King County jury found Evergreen Hospital guilty of ignoring fetal distress signs, while nurses failed to notify a physician in time for an emergency C-section.
In turn, the girl was born with brain damage, which led to cerebral palsy. She’s now severely disabled and has a shortened life span.
“This tragedy was caused when attending nurses did not notify a doctor in time to do a crash C-section which could have prevented the injury,” one of the girl’s lawyers said.
Despite the hospital denying negligence, the presiding judge sided with the victim in the case. Damages awarded include future medical and home care expenses, as well as damages for pain and suffering, past medical bills, and lost capacity of future earnings.
